Ben Hersh Estate Sales Shipping Terms

• Shipping is available for qualifying auction items. We do not yet offer shipping for furniture or oversized items, but you are welcome to obtain a freight quote of your own and have them coordinate with our staff.

• Shipping costs are calculated based on the size, weight, and destination of the item, buyer is responsible for all shipping charges.

• Packing and handling fees may apply.

• Insurance is recommended for all shipped items.

• Ben Hersh Estate Sales is not responsible for lost or damaged items.

• Items must be paid for in full before they can be shipped, a shipping invoice will be emailed to buyer once their auction invoice has been paid and shipping rate calculated.

• Shipping times vary depending on the destination.

• Ben Hersh Estate Sales uses a variety of shipping carriers, including FedEx, UPS, and USPS.

Auction Terms and Conditions

*All items as sold "As is and where is" with all faults *We do our best to represent each item to the best of our ability, but we are not responsible for imperfections not mentioned in the description. * All descriptions believed accurate but not warranted. 

1. Registration: To participate in the online auction, you must register and create an account. You must provide accurate and complete information, including your legal name, address, email address, and Payment Method and phone number. As a registered bidder, you must agree to abide by the Terms and Conditions

2. Bidding: Bidding will take place online through the auction platform. You must place a bid that is higher than the current bid. Bids cannot be retracted or modified once they have been placed.

3. Payment: The winning bidder must pay for the item in full within 24 hours of the auction's end. Payment can be made by credit card, debit card.  Invoices not paid within the 24 hour time period will be charged to the credit card on file. 

4. Item Description:  Items are described to the best of our ability. However, Ben Hersh Estate Sales makes no warranties or representations regarding the condition, authenticity, or value of any item. All items are sold "as is." 

5. Shipping:

• Shipping is available for qualifying auction items. We do not yet offer shipping for furniture or oversized items, but you are welcome to obtain a freight quote of your own and have them coordinate with our staff.

• The Buyer is responsible for shipping the winning Lots. Shipping costs will be calculated based on the item's size, weight, and destination. We do not ship internationally

6. Returns: All sales are final. No refunds or exchanges will be allowed.

7. Liability: The seller is not liable for any damages or injuries caused by the item once it has been delivered to the winning bidder.

8. Disputes: Any disputes arising from the online auction will be resolved through arbitration.

9. Governing Law: The online auction will be governed by the laws of the State of New Jersey.

Entire Agreement: These terms and conditions constitute the entire agreement between the buyer and seller and supersede any prior understandings or agreements. 

* We reserve the right to reject any bid at our sole discretion.  

*All payments must be made in US Dollars. 

 * Buyer's premium is 15%

PICK UP LOCATION: Unless otherwise noted, all auction items will be picked up from 408 Bloomfield Dr Unit 5 West Berlin NJ 08091.

PICK UP DATES & TIMES: Sunday December 22nd, 2024 from 10:00 am to 1:00 pm. We appreciate that sometimes buyers have a timing conflict so please reach out to us to make other arrangements if necessary. Also, delivery may be available, please reach out to discuss same.

SHIPPING: Shipping may be available for many items at buyer's request and expense. NO FURNITURE items are available for shipping and small items weighing in excess of a certain amount may not be available for shipping. Please contact us via email at info@benhershestatesales.com to discuss if shipping for your item is possible. 

PACKAGING MATERIALS: You must bring your own help and packaging for your items. We may not have help available to assist with heavy items.
